    【摘要】2016年,趙先生位于沈陽市某區(qū)的50平的房屋被區(qū)政府強拆了,2022年,法院判決區(qū)政府強拆趙先生房屋的行為違法。判決生效后,趙先生于2023年向區(qū)政府郵寄了《國家賠償申請書》,并向沈陽市中級人民法院提起行政賠償訴訟,一審法院按照2016年的補償標準,判決區(qū)政府賠償8萬元。如今過去8年之久,8萬元的賠償金明顯低于同類房屋的市場價值,這樣合理嗎?應(yīng)當按照哪年的標準來補償呢?

     不合理,房屋被違法強拆,正常的賠償標準,應(yīng)當是由拆遷人提供一套不低于被拆除房屋使用標準、使用價值的房屋。但是趙先生房屋已經(jīng)被拆,無法恢復,雙方也未簽訂安置補償協(xié)議,只能按貨幣進行賠償。強拆已過八年多,該筆賠償金無法購得最低使用標準用房,一審法院確定的賠償數(shù)額不當,應(yīng)予糾正。由于趙先生被侵權(quán)后,合法權(quán)益長期未得到修復和補救,可以參照當?shù)氐禺a(chǎn)開發(fā)研究會公布2023年商品住宅成交價數(shù)據(jù),按照每平方米金額進行賠償。

    《中華人民共和國行政訴訟法》

    第七十六條規(guī)定,人民法院判決確認違法或者無效的,可以同時判決責令被告采取補救措施;給原告造成損失的,依法判決被告承擔賠償責任。

    《國有土地上房屋征收與補償條例》

    第十九條第一款規(guī)定,對被征收房屋價值的補償,不得低于房屋征收決定公告之日被征收房屋類似房地產(chǎn)的市場價格。評估時點確定的目的是便于評估被征收房屋的價值,切實保障被征收人的合法權(quán)益。政府在房屋征收補償過程中,如果未能與被征收人簽訂補償安置協(xié)議,應(yīng)當及時作出補償決定。
